Italian Hub Hosts Workshop on Third-Party Litigation Funding in the EU

On 13 September 2024 (10:00–18:00 CET), the Hub discusses litigation funding and access to justice at the Roma Tre University.

This event is a collaborative effort between Università Roma Tre and the University of Turin, led by Prof Cristina Poncibò (University of Turin) and Prof Maria Cecilia Paglietti (Università Roma Tre).

The workshop will explore the impact of Third-Party Litigation Funding, where external investors finance lawsuits in exchange for a share of the proceeds. This raises concerns about access to justice, conflicts of interest and transparency. With Europe currently debating the best regulatory approach, the workshop aims to foster expert discussion on these issues.

Dr Cesare Cavallini (Bocconi University) will chair the session, which will begin with a discussion on the pitfalls of the proposed Directive on Responsible Private Funding of Litigation. Topics will include:

  • Systematising substantive and procedural issues
  • Distinguishing litigation finance from other forms of claim monetization
  • Examining Third-Party Litigation Funding in EU Member States
  • Evaluating the regulatory force of soft law
  • Assessing the authority of third-party funders to influence trial strategies

 

The workshop will be held in person at the Department of Law, Roma Tre University, via Ostiense n 159, Sala del Consiglio (I Floor).
