Conference on Property Law in Madrid

Recent decisions of the Court of Justice of the European Union with origin in previous pre-judiciary claims from Spanish judges have led to recent legal modifications and threaten to provoke Spain forfeiting being one of the countries with the lowest interest rates in the EU. In a Conference on 12 June 2017, the above consequence was discussed.

To discuss this challenge and the state of play in Europe, the Colegio de Registradores de España and the ELI-Spanish Hub co-organised a seminar that focused on various current issues relating to the real estate credit market in Europe. Experts from Austria, France, Germany, Italy, Spain and the Netherlands gave presentations relating to the state of play in their respective countries with reference to:

  • Variable interest rates: ground and ceiling clauses
  • Unfair terms in mortgage credit contracts and procedures to declare their inefficacy
  • Mortgage execution procedures and objections to enforcement/grounds of opposition, and, if so, specialities of the residential mortgage execution procedure

The seminar was held in Madrid at the Registrars’ Corporation located on Calle Diego de León 21 on Monday, 12 June 2017.
