The consultation paper considers the relationship between formal and informal justice and considers the risks posed by the increasing prevalence of many different forms of ADR. The paper also proposes three possible outcomes for the project:

(i) the preparation of a statement of European best practice in relation to the approach that courts and judges should adopt in interacting with all types of ADR processes;

(ii) the preparation of a statement of European best practice in relation to the approach that those responsible for all types of ADR processes should adopt in interacting with courts and judges, and

(iii) making recommendations as to the best European models that can be developed and applied for coherent access to dispute resolution processes in respect of different types of dispute, and towards which Member States may wish to progress.
