Conference on Rescue of Business in Insolvency Law

The European Law Institute (ELI) and Business and Liability Research Network (BLRN) of the Leiden Law School organised a conference on restructuring of corporate groups in the afternoon of 5 December 2018. The ELI’s Instrument on Rescue of Business in Insolvency Law drafted under the leadership of Prof Em Bob Wessels and Prof Stephan Madaus was the starting point for discussions on the treatment of insolvent corporate groups.

Bob Wessels (Leiden University, The Netherlands) and Stephan Madaus (Halle-Wittenberg University, Germany) introduced the ELI Instrument and the results of this European study with respect to restructuring of corporate groups in Europe. Prof Joeri Vananroye (KU Leuven, Belgium) discussed Belgian perspectives of corporate restructuring and Prof Reinout Vriesendorp (Leiden University, The Netherlands) elaborated on issues of director’s liability. Leiden Law School researchers Jessie Pool, Ilya Kokorin and Gert-Jan Boon presented a case study on corporate groups.

After the presentations a lively discussion followed. This well attended event enabled an exchange between insolvency law experts, including judges, lawyers in private practice and academics from all over Europe.

ELI Instrument on Rescue of Business in Insolvency Law

The Instrument was unanimously adopted by the ELI bodies in 2017. Bob Wessels and  Stephan Madaus acted as Reporters for this project. Based on extensive national reports, they prepared a report with some 115 recommendations on the rescue of businesses in distress. In this EU-wide study they also looked into the treatment of corporate groups across Europe. The report, recently cited by the UK Government, is available here.

Another event on Insolvency law will be held on 11 December 2018 in Vienna (Austria) and the registration is still open. You can find more details here.
