ELI as Observer at the 57th Session of the UNCITRAL Commission

From 8–12 July 2024, ELI Scientific Director represented ELI at the UNCITRAL Commission’s 57th session in New York

The United Nations Commission on International Trade Law (UNCITRAL) recently adopted a Model Law on Automated Contracting with a guide to enactment. ELI, which is working on Guiding Principles and Model Rules on Algorithmic Contracts, and recently published its Guiding Principles on Algorithmic Decision Making authored by Teresa Rodríguez de las Heras Ballell, Christoph Busch, Marie Jull Sørensen, Dariusz Szostek (until October 2023), and Christian Twigg-Flesner have been in close contact with UNCITRAL, one of its members, about its work in the field. Christiane Wendehorst, who is the author of a set of ‘Principles for AI in Contracting’ and the ELI’s Scientific Director, joined discussions in New York on ELI’s behalf. She was also the European Reporter of the ALI-ELI Principles on the Data Economy – Data Transactions and Data Rights, a project conducted jointly with the American Law Institute (ALI), that has significantly influenced legal development worldwide. 

The outcome of UNCITRAL’s Working Group IV's (E-Commerce) 66th session, which took place in Vienna in October 2023 and revolved around drafting model precisions related to automated contracting, particularly in the context of artificial intelligence, and data provision contracts, took center stage. Wendehorst took part in the discussions as a renowned expert in these topics.
