Ahead of the Data Act’s application from 12 September 2025, the Commission will develop and recommend Model Contractual Terms (MCTs) for data sharing and Standard Contractual Clauses (SCCs) for cloud computing services. The aim is to assist especially small and medium-sized businesses in negotiating fair and balanced contracts. An Expert Group, including ELI Scientific Director, Prof Dr Christiane Wendehorst and ELI President-Elect, Prof Dr Teresa Rodríguez de las Heras Ballell, has been working since 2022 to prepare the draft proposals.
To present and discuss the Expert Group’s findings, the European Commission will host a series of webinars with businesses, policymakers, lawyers, and experts on 10 and 11 April 2025. We would particularly like to draw attention to a webinar on voluntary data sharing, highly relevant also to United Nations Commission On International Trade Law’s (UNCITRAL) work on data provision contracts. ELI’s Scientific Director, Prof Dr Christiane Wendehorst, will speak at the webinar which will take place on 11 April 2025 from 14:00–17:00 CET. UNCITRAL’s working group's work on the topic is largely based on the ALI-ELI Principles for a Data Economy, developed by Prof Dr Christiane Wendehorst and Prof Dr Neil B Cohen.
