ELI Turkish Hub Webinar on UNIDROIT’s Principles on Digital Assets and Private Law

On 18 July 2023, the ELI Turkish Hub held a webinar on UNIDROIT’s Principles on Digital Assets and Private Law.

The webinar, which is part of a series of webinars aimed at discussing recent developments in European law, drew 20 participants.

It was opened Dr Bora Kaya (ELI Turkish Hub Co-Chair; Ankara Bar Association) and was followed by discussions led by Prof Kadir Berk Kapancı (ELI Turkish Hub Co-Chair; MEF University, Istanbul) and Prof Ekin Ömeroğlu (Kadir Has University, Istanbul). Prof Kadir Berk Kapancı introduced the ‘UNIDROIT Principles on Digital Assets and Private Law’ and spoke about the motives behind them, before exploring specific principles on the concepts of control, linked assets, transfer, custody and secured transactions. Subsequently, Prof Ekin Ömeroğlu expanded on Principle 5 on applicable law.

The lectures were followed by a lively Q&A session during which participants discuss various problems including the scope of the term ‘digital assets’ and the term ‘transfer’ as well as the possible impacts of the Principles on Turkish law.
