The proposal for the above Directive was analysed in the ELI Report on Ecocide, which was published earlier this year and which aimed at providing guidance for inter-institutional negotiations at EU level. To this end, ELI developed a Model Directive, which was closely based on the European Commission’s initial proposal, with new Articles 3, 4, 5, 7 and 11. New definitions were also inserted into Article 2.
ELI welcomes the recent developments at EU level, which will serve to strengthen environmental protection through criminal law measures.
