Insurance Law SIG’s Second Transatlantic Lecture on Insurance Law

27.05.2021

On 27 May 2021, the ELI Insurance Law SIG organised a second transatlantic lecture on insurance law, which dealt with COVID-19 and reinsurance.

Helmut Heiss (Professor, University of Zurich; Co-Director of the PRICL Project) and Marta Ostrowska (General Secretary of the PRICL Project, University of Zurich and University of Warsaw) delivered an introduction to COVID-19 losses, PRICL and the UNIDROIT Principles of International Commercial Contracts (PICC).

Ignacio Tirado (Professor; Secretary-General of UNIDROIT) and Anna Veneziano (Professor; Deputy Secretary-General of UNIDROIT) presented the Note on the UNIDROIT Principles of International Commercial Contracts and the COVID-19 health crisis.

This was followed by a presentation addressing the aggregation of COVID-19 losses under the PRICL by Oliver D William (Senior Researcher, University of Bern; Special Advisor of the PRICL Project).

Jeffrey W Stempel (Professor, University of Nevada, Las Vegas) and Kevin Bork (Deputy General Counsel, Helvetia Insurance Germany; Special Advisor of the PRICL Project) then discussed the issue of follow-the-settlements clauses of COVID-19 losses and follow-the-fortunes clauses under the PRICL.

The lecture was concluded with remarks on COVID-19 challenges for (re-)insurance law by Manfred Wandt (Professor, Goethe-University, Frankfurt/Main; Co-Director of the PRICL Project).

The presentations from the lecture are available below:

The lecture series represents a transatlantic joint venture in which leading experts from Europe, North America, South America and Africa discuss fundamental questions of insurance law online. Two further lectures will be organised in autumn, namely on 23 September and 11 November 2021. More information is available here.
