ELI Principles Governing the Third Party Funding of Litigation Discussed at Bocconi

On 28 November 2025, the European Law Institute’s (ELI) Principles Governing the Third-Party Funding of Litigation were presented at Bocconi University by Susanne Augenhofer, Project Co-Reporter and ELI Council member.

Against the backdrop of the European Commission’s recent decision not to regulate third-party litigation funding (TPFL), Augenhofer outlined the crucial role the ELI Principles can play in filling this regulatory gap. She underlined that in a fast-growing global TPFL market, clear guidance is urgently needed to support litigants, funders, legal advisors, and regulators.

The Principles, developed through extensive comparative research and expert consultation, aim to promote transparency, fairness, and accessibility in funding arrangements. They offer a flexible yet robust framework that jurisdictions may incorporate into legislation or regulatory practice to ensure effective oversight and enforcement.

The ELI encourages policymakers across Europe to consider adopting the Principles as an essential tool for strengthening trust and accountability in TPFL.
