Participants met to discuss the second part of the project’s questionnaire prepared by the Reporters that deals with EU policy questions. The questionnaire will form a basis for preparing a policy statement, which will present the output of the first phase of the project.
Advisors and Members Consultative Committee members already provided some feedback on the initial version of the questionnaire earlier this year, and the workshop was an opportunity to further reflect on the questionnaire and discuss potential answers.
The project aims to propose an EU legislative reform to address the challenges resulting from the recent trend of shifting the competences in administration of justice in the field of family and succession law from courts to other authorities, or to the parties themselves. As all current EU instruments assume that justice is mainly carried out by courts and not other authorities, many questions therefore arise in relation to private international law and jurisdiction rules and their applicability to these other authorities.
