Background

Public administration, being an emanation of the State's public functions, entails the processing of much more data than private entities. New technologies, such as artificial intelligence, can therefore play a significant role in the modernisation and overall improvement of the functioning of public administration. On the other hand, a guarantee of the transparency, correctness and security of the processed data is also fundamental. Therefore, the possibilities to implement AI in the operation of public administration are limited by the principle of legality and the need to ensure a high degree of reliability of technologies used, as well as the need to ensure the respect of citizens’ rights.

Public administration is, as a result, confronted with specific challenges in the deployment of AI and, more generally, algorithms. The use of these techniques poses specific problems related to the particular requirements associated with the principle of good administration. In addition, issues such as transparency, accountability, compliance and non-discrimination are particularly relevant in the context of public administration.

This project follows on from a preceding feasibility study, which identified issues to be addressed in more detail in the project and provided an insight into the final output.

 

Aim

The project aims to lay down a basis for developing procedures on artificial intelligence that will not hinder innovation while providing solid safeguards to improve citizens' confidence in the use of the technology. These could serve as inspiration to national as well as EU legislators but also governments and administrations.

 

Outcome

Following an already successful approach in environmental law, the project will develop a set of model rules that include the need to conduct an impact assessment and a public consultation prior to the introduction of an AI-based tool in the realm of public administration.

Alternative rules will also be discussed and proposed to facilitate the adaptation of rules to different levels of ambition. 

The elaboration of model rules is consistent with and will complement the approach taken by the European Union in the development of trustworthy AI.
