The above was part of an ongoing webinar series aimed at fostering discussion on current ELI projects and recent developments in Croatian, comparative, and EU law. The webinar brought together 40 participants from Croatia, Bosnia and Herzegovina, Serbia, and Slovenia.
The event commenced with a welcome address from Prof Emilia Mišćenić (ELI Croatian Hub Co-Chair; Professor at the University of Rijeka, Faculty of Law).
This was followed by an insightful lecture on ‘Change of Debtor in Comparative Perspective’, by Professor Marija Karanikić Mirić (University of Belgrade, Faculty of Law).
In her lecture, Professor Karanikić Mirić explored the origins, comparative models, and modern forms of rules on the change of debtor (substitution of an original debtor with a third party). Particular focus was given to the contrast between Romanistic legal systems, which traditionally had not accepted that a change of debtor can be made in a way that would preserve the obligation, and Germanic legal systems which accept that a change of debtor does not have to extinguish the obligation. Professor Karanikić Mirić addressed the introduction of la cession de dette to the Code civil with a 2016 reform of the French law of obligations, as well as the rules on the change of debtor in legal systems that inherited the Yugoslav Law on Obligations.
Following the lecture, an engaging Q&A session ensued, allowing participants to actively contribute to the discussion.
