2023 ELI Annual Conference: Family and Succession Law SIG Held a Panel on the Recognition of Filiation in Europe

On 8 September 2023, the Family and Succession Law SIG held a panel entitled ‘Recognition of Filiation in Europe: e pluribus unum,' within the framework of the 2023 ELI Annual Conference at the University of Vienna.

Elena Bargelli (Full professor, University of Pisa), Ilaria Pretelli (Senior Research Fellow, Swiss Institute of Comparative Law; Editor, Yearbook of Private International Law; Visiting Professor, Paris Sud University), Valentina Calderai (Associate Professor, University of Pisa), Cristina González Beilfuss (Full Professor, University of Barcelona) and Jens Scherpe (Professor, Aalborg University; Director, Nordic Centre for Comparative and International Family Law) delved into the multifaceted challenges that family law faces across the European Union (EU), where differing viewpoints on civilization and legal evolution come into play.

These perspectives transcend national boundaries and encompass pressing issues such as the regulation of gametes, surrogacy, and the rights of same-sex couples. Of paramount concern was the examination of how these divergent legal approaches impact the well-being of children. The panel not only explored the complex implications of varying legal approaches but also contemplated the role of traditional private international law tools in striking a delicate balance between safeguarding the universal rights of children and respecting the diversity of national identities and values.
