The Supreme Court of Justice (Cour supérieure de justice) is the highest judicial authority in Luxembourg in civil and commercial matters. It comprises the Court of Cassation (Cour de cassation), the Court of Appeal (Cour d’appel), the High Council of Social Security (Conseil supérieur de la sécurité sociale) and the Prosecutor General's Office (Parquet général).
· The Court of cassation is Luxembourg’s highest court of last instance. It ensures the correct application of the law by reviewing the legality of judicial decisions without re-examining the facts of the case. It handles requests for annulment (cassation) of decisions made by the various chambers of the Court of Appeal, the High Council of Social Security and judgments rendered in the last resort by lower courts.
· The Court of Appeal deals with civil, commercial, criminal, and labor disputes from Luxembourg’s two judicial districts.
· The High Council of Social Security is the appellate body in matters of social security.
· The Prosecutor General's Office led by the General Public Prosecutor (Procureur général d’État), represents the interests of the public in proceedings held at the Supreme Court of Justice. They also provide legal opinions to the Court of Cassation on cases that are brought before it, helping guide the court in making its decisions. The office is also responsible for overseeing the execution of sentences, managing the central social assistance service, providing judicial information to individuals and lawyers, and handles international legal assistance in criminal, civil and commercial matters.
